What to Expect When Charged with a Felony

By definition, a felony is termed as a crime which can be punishable by at least one year and one day, (366 days of imprisonment), and can be categorized as a violent or non-violent offense. The end result for a felony crime can be less significant in regards to the jail sentence but may have a much more damaging effect on the arrestee’s records. A felony charge may cause people in the workforce problems in their professional lives. These days, employers may hesitate to keep an employee on salary, especially with a felony on their record.

Examples of Felony Crimes

Felonies can be classified by both their seriousness and punishment. Examples of felony crimes include: homicide, treason, illegal drug abuse or sales, battery, arson, possession of methamphetamines or cocaine, burglary, vehicular manslaughter, tax evasion, theft over $500 dollars, aggravated assault, racketeering, embezzlement, espionage, robbery, murder, kidnapping and fraud. Felonies, even those on the more minor side, can carry the potential for very significant fines as well as prison time.

Arrest and Booking Process

Whenever someone is arrested for a felony in California, they will typically be transported to a local law enforcement agency/station for processing and booking. This consists of fingerprinting, photos, background checks, etc. Arrestees may also be taken to a local police department or sheriff’s station holding facility or jail. Once an arrestee has been booked and processed into the county computer system, they may be eligible for bail release.

The California booking process can take quite a long time, depending upon the size of the jail facility and how busy the station staff is. Occasionally, booking can be completed within one hour, and other times it may take as long as 24 hours. Generally, by rule, the larger the jail is, the longer the booking process takes.

Release Options

In California, there are different options for release from jail. These options include: Bail Bonds, Own Recognizance (“O.R.”), Citation Release (“Cite Out”), Property Bonds and Cash Bonds. Bail can typically be posted at most California jails, 24-hours a day. After the individual has been booked, they may be released from jail on bail bond or otherwise or they may be held until arraignment if no bail is posted. Arraignment generally takes place within two business days. As an example, if someone is arrested on Wednesday evening, they would generally be arraigned on the following Monday morning.

Indemnitor Responsibilities

When you bail someone out of jail, you are telling the bondsman that you know the person and are confident they will show up for their court dates. As the indemnitor, for some reason should the person fail to appear on their court appointed date, you will be required to assist the bail bond company in locating the defendant and returning them to court. The majority of bail bond issues can be easily resolved. Most courts understand that people get ill, have auto issues, or simply forget. Generally, a phone call to our company can take care of those situations.

Bail Bond Fees

By law, the California bail bond fee costs are usually 10% of the total amount of bail. For example, if the bail amount has been set at $75,000; you will be charged a non-refundable $7,500 fee from the bail bond company. While most of our clients choose to pay by major credit card, we also accept cash and offer several convenient bail bond payment plans.
